Park West Gallery Thumped Again!

Oh dear! There's more bad news for the beleaguered Park West Gallery of Southfield, Michigan.

On April 29, 2009, the Honorable Robert S. Lasnik ordered that "Park West and its closely-affiliated company, Fine Art Sales" must defend claims filed against them by the Plaintiffs in the State of Washington. Park West Gallery had tried without success to convince the court to transfer the case from the State of Washington to Florida, where a much more favorable forum exists for them, and where Park West Gallery is used to litigating and bludgeoning any opposition.

The claims against Park West Gallery and Fine Art Sales, according to Judge Lasnik's order include: engaging in a scheme to misrepresent the authenticity and value of artwork sold on cruise ships, claims for unjust enrichment, consumer protection act violations, and RICO claims (Racketeer Influenced and Corrupt Organizations), in addition to breach of contract and breach of warranty claims.

As a side note: It was interesting to learn from the Judge's Order that Fine Art Sales has ceased operations. Fine Art Sales is alleged by Park West Gallery to be its "affiliate". It is also alleged in the Washington State Class Action complaint that Fine Art Sales, Inc. issued Certificates of Authenticity to buyers of Park West Gallery artwork "that falsely represented the authorship of the works sold."
